Rectify 2020 General Election Results

 

Here's the text of a follow up email I sent to the swing states that experienced election irregularities during the 2020 General Election. A list of all the email addresses of state legislators can be found in my previous post "2020 Election Integrity"

Rectify 2020 General Election Results

 


Dear Representative/Senator:

 

Since the judicial branch on neither the state nor federal level has afforded an adequate forum to air let alone redress the grievances of President Trump supporters arising from the irregularities in the 2020 General Election, I'm urging the Georgia legislature to exercise its Constitutional authority under Article II, Section 1, Clause 2 to appoint presidential electors.

You have PLENARY power. Contrary to the position expressed in the 8 December 2020 "Majority Statement on Elections," 1 state constitutional requirement requiring the acquiescence of governors, or a 2/3 vote, is preempted by US statutes & Supreme Court decisions.

 

1) Per McPherson v. Blacker (1893) and Bush v. Gore (2000), re their role in appointing electors, state legislatures have “plenary” power.

2) Plenary = “absolute” authority with regards to a duty, and it cannot be questioned.

3) This right was exercised by the Florida, South Carolina, Louisiana, and Oregon during the 1876 Election. It was also being exercised in Florida during the 2000 Election, before SCOTUS intervened to end the recounts.

4) In McPherson, SCOTUS held Article II “constrains each state's capacity to limit its legislature's ability to appoint electors”.

5) Consequently, no state constitution’s law can abrogate or alter the State Legislatures’ power in appointing electors. Even a state’s typical special session requirements (such as a governor’s agreement, or call, or a 2/3 majority) are not relevant.

6) This is because on deciding the manner of choosing electors, a state is NOT acting as a state body, but as a federal body.2

 

Peter Navarro 22 December 2020 report 3 documented election irregularities in 6 key swing states, including Georgia, Irregularities in Georgia resulted in >400,000 ballots in question which exceeds the 12,670 supposed victory margin of Biden for this state.

Senator William T Ligon's Chairman Report 4 qualitatively corroborates Navarro's findings of election irregularities and recommends, upon concurrence of the majority of the Legislature, that the current certification of the 2020 presidential election should be rescinded.

On January 6th, the slates will be counted by the President of the Senate. I implore you to take up your US Constitutional duty now, and as joint body acting in a federal capacity, call a special session to decertify your executive branch's current slate of electors, and to appoint electors that declare President Trump the winner of Georgia.

Since the judicial branch on neither the state nor federal level has afforded an adequate forum to air let alone redress the grievances of President Trump supporters arising from the irregularities in the 2020 General Election, I'm urging the Pennsylvania legislature to exercise its Constitutional authority under Article II, Section 1, Clause 2 to appoint presidential electors.

You have PLENARY power. The plenary powers of state legislatures to choose presidential electors invested in them from the US Constitution supersedes constraints placed on them by state constitutions, as Constitutional legal scholar Dr. John C. Eastman has asserted: 1
